Introduction

Fast Pathway, Inc. ("Fast Pathway" or "we") cares about how your personal information is used and shared and takes your privacy seriously. This Privacy Policy applies to: (a) our DocClocker and Doc-OR mobile applications (the "App"), (b) the web site at www.docclocker.com, and all related portals and web sites (collectively, the "Sites"), and (c) all related technologies, software, content, and services. The foregoing items are collectively referred to in this Policy as the "Services."

We are committed to safeguarding and protecting your personal information, including health information, in accordance with all applicable law, including as applicable the Health Insurance Portability and Accountability Act ("HIPAA").

We are providing this Privacy Policy to inform you of our policies and procedures regarding the collection, use, and disclosure of the information that we collect and receive from you. This Privacy Policy does not apply to activities that occur offline or to information we collect outside of the Services, including e-mails, letters and other communications that you send us outside of the Services.

By accepting the Terms of Use for the Services (the "Terms") during registration, or by using the Services, you expressly consent to our collection, use, and disclosure of your Personal Information (as defined below) in accordance with this Privacy Policy.

Collection of Personal Data

Our Services allow you to contact us and provide us with your email address, your name, and other information you may share within a contact form and email you send to us, as generated through our Sites or Services. You may visit our Sites without telling us who you are.

We also collect information you provide voluntarily in free-form text boxes on the Services and through responses to surveys, questionnaires and the like.

When using the App and other Services, we will ask you for certain personally identifiable information necessary for use of the App and other Services, and for communicating with you. The data collected includes information about you that can be used to contact or identify you, and information related to your use or potential use of App. Personal information that we collect from you may include the following:

PHI

We may act as a "Business Associate" under HIPAA when we receive personal information related to your health about you from or on behalf of your healthcare providers ("PHI").

HIPAA provides specific protections for the privacy and security of PHI and restricts how PHI is used and disclosed. Fast Pathway may only use and disclose your PHI in the ways permitted by HIPAA and your healthcare providers.

You may be asked to electronically sign a consent form regarding use of some of our Services, presented to you by your healthcare providers or by us. It is entirely your decision whether to e-sign any such consent.

Use of Cookies and Tracking Systems on the Sites

A cookie is a small data file that certain websites write to your hard drive when you visit them. A cookie file can contain information such as a user ID that the site uses to track your activity and preferences.

The Sites use cookies to track user traffic patterns, and may use third-party software to determine the usefulness of our Sites' information to our users and to see how effective our navigational structure is in helping users reach that information. If you prefer not to receive cookies while browsing our Sites, you can set your browser to warn you before accepting cookies and refuse the cookie when your browser alerts you to its presence. You can also refuse all cookies by turning them off in your browser. Certain functionality on the Sites may depend on cookies however.

Fast Pathway also may use web beacons or pixel tags which are small graphics files used to track number of users at our Sites and the navigation through our Sites. We do not use this data to track personally identifiable information. We may also collect IP addresses of persons visiting our Sites. We may use IP address to aggregate information about the number of visitors to our Sites, usage of our Sites and the general locations from where our Sites are accessed. We do not generally use IP addresses to track personally identifiable information. We reserve the right to use IP addresses to identify persons who abuse or threaten our Sites or our officers, managers, employees, or customers. We may also use other tracking technologies, but do not intend to use such technologies to collect personally identifiable information.

Use of Tracking Systems on the App

We may use data files written to your device when you use our App to track certain ways you use the App.

We may also collect device identifiers of devices using the App. We may use the information to aggregate information about the number of users of our App, App usage and from where our App is accessed. We do not generally use device identifiers to track personally identifiable information. We reserve the right to use device identifiers to identify persons who abuse our App, or threaten our agents, employees, or other users. We may also use other tracking technologies, but do not intend to use such technologies to collect personally identifiable information.

We may use interest-based or online behavioral advertising. This means that some of our partners use tracking tools to display our ads on other websites or services based on information about your use of the Services or your interests (as inferred from online activity). Such partners may include third-party service providers, advertisers, advertising networks or platforms, and agencies. Other tools used by our partners may collect information when you use the Services, such as IP address, mobile device ID, operating system, browser, web page interactions, geographic location and demographic information, such as gender and age range. These tools help us learn more about our users' demographics and internet behaviors.

We do not use or share your personal information with others except as indicated in this Privacy Policy or the Terms.

Comments or questions sent to us through the Services will be shared with our staff that is most likely to be able to address your concerns. We may archive your messages once we have provided you with a response. Please note that email communications will not necessarily be secure; accordingly, you should not include credit card information, PHI, or other sensitive information in email correspondence with us. Fast Pathway may aggregate your information with other users' information to determine and distribute aggregated statistics and information about the Services and its use and users. This aggregated information will not identify any specific user.

You agree that any information that you may post in a review or online forum is intentionally open to the public and is not in any way private. We recommend that you carefully consider whether to disclose any personal information in any public posting or forum. What you have written may be seen and/or collected by third parties and may be used by others in ways we are unable to control or predict.

Third Parties and Links

This Privacy Policy applies only to our Services. We may provide links to other information and sites that we believe may be of interest to our users. Their sites may collect or request personally identifiable information from you. You should review the privacy policy of these sites before providing such information, as these sites are not covered by our Privacy Policy. We cannot guarantee the standards of sites to which we link or be responsible for the contents, or privacy practices and policies, of these and other third-party sites. We encourage you to read the privacy policy of every site you visit.

This Privacy Policy does not modify any agreements or privacy policies in place between you and your healthcare providers, or other third party. We encourage you to review any such documents and see how your personal information may be used or disclosed by any such third party.

Access to Acccount

If you are a registered user of the Services, you can change your account information through the user profile page in the Services. You may need to supply certain information so that we can try to verify that you have authority to modify this information.

You may also request that we delete your Personal Information, by emailing us at support@docclocker.com We will make diligent efforts to process such requests promptly. We will not however delete your username which is your e-mail address. Also, we may retain information to verify compliance with our Terms of Use, with applicable law, and for other legal purposes.

Opt-Out

We provide you the opportunity to opt-out of receiving certain communications from us, by emailing us at support@docclocker.com In addition, all marketing e-mails from Fast Pathway will provide you with the opportunity to unsubscribe from future marketing mailings. Even if you opt out of such mailings, however, we reserve the right to send you e-mail and other communications to disclose maintenance and other service-related issues.

Legal Requirements

We intend to protect your privacy to the fullest extent possible as described in this policy while also fulfilling our responsibility to uphold all applicable laws and regulations. Due to potential legal requirements and other possible circumstances, we cannot ensure that all of your private communications and other personally identifiable information will never be disclosed or accessed in ways not otherwise described in this policy. We may be compelled under law to disclose information to government or third parties under certain circumstances or third parties may unlawfully intercept or access transmissions or private communications. The Services are hosted in the United States. If you are accessing the Services from outside the United States, you agree that through your continued use of the Services, which is governed by U.S. law and this Privacy Policy, you are transferring your personal information to the United States and you consent to that transfer.

Security Measures

We have implemented reasonable and industry standard security measures on the Services to help protect against the loss, misuse and alteration of the personal information under our control. Additionally, we take reasonable steps to ensure that our third-party business partners, including our hosting partners, provide sufficient protection for personal information.

You acknowledge that no method of transmission over the Internet, or method of electronic storage, is 100% secure, and that we cannot guarantee absolute security. If you have any questions about security on our Services, you may contact us. We will promptly make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored "personal data" (as defined in applicable state laws on security breach notification) to you as required by law.

Privacy of Children

Children under age 18 are not permitted to use the Services. We will not knowingly collect personally identifiable information on the Services from children under 18. If we become aware that a user of the Services is under the age of 18 and has provided us with Personal Information, we may delete such information from our files and may deactivate the related account.

Changes to this Privacy Policy

This policy may be revised by us from time to time. By using the Services, you agree that we have a right to change our policy without prior notification. The revised policy will appear on our app and/or web site with the date of last revision. Your continued use of the Services following such revisions will be conclusively deemed acceptance of any changes to these Terms.
